Welcome to eBalkan Marketplace (eBM). By accessing or using our website (realestate.e-balkan.com), mobile applications, or related services (hereinafter: Platform), you agree to these Terms of Use. Please read them carefully. If you do not agree with any part of these terms, please do not use the Platform.

1. ABOUT US AND OUR ROLE

The Platform is operated by eBalkan Marketplace, registered in the Republic of Kosovo under the Business Registration Number 123456789. eBM acts as a digital intermediary and technological hub. We provide the infrastructure to connect:

• Buyers and Tenants with Real Estate Agencies and Agents.
• Investors with investment opportunities.
• Furniture/Service Buyers with Vendors (suppliers) and Contractors (“Home & Living”).

eBM is not the owner of the advertised properties (unless otherwise stated) nor the direct seller of goods in the “Home & Living” sector (we operate as a Marketplace).

2. DEFINITIONS

• User: Any person accessing the Platform (registered or unregistered).
• Partner: A legal or natural person who has a specific B2B contract with eBM (Agency, Vendor, Partner).
• Private Asset: Data (clients, contracts) entered into the system by an Agency, which remains the exclusive property of that Agency.
• Shared Asset: Data generated by the Platform, which is the property of eBM.
• Content: Texts, images, videos, databases, and software code.

3. REGISTRATION AND ACCOUNT SECURITY

• Data Accuracy: When registering, you agree to provide true, accurate, and complete information. The use of fake names or other people’s data is strictly prohibited.
• Security: You are solely responsible for maintaining the confidentiality of your password. eBM is not liable for any damage resulting from unauthorized use of your account.
• Verification: For certain roles (Agency, Agent, Investor), eBM reserves the right to request additional documentation (ID, business registration) for identity verification and AML (Anti-Money Laundering) compliance.

4. USER CONDUCT

The following actions are strictly prohibited:

• Bypass: Attempting to contact an Agency or Vendor directly to avoid recording the transaction through the Platform and evade commission fees.
• Scraping: Using automated software (bots, scrapers) to collect data on properties or users from the Platform.
• False Advertising: Posting properties that do not exist, are already sold, or entering incorrect prices (“bait-and-switch” ads).
• Disruption: Introducing viruses or attempting to crash the site.

5. INTELLECTUAL PROPERTY AND DATA OWNERSHIP

• Platform Rights: All design, logos, code, databases, and analytical reports are the exclusive property of eBM and are protected by copyright laws.
• User Content: By posting ads (images, descriptions), you grant eBM a non-exclusive, royalty-free license to display, distribute, and promote that content on the Platform.
• Private Asset Protection: eBM commits that data defined as “Private Asset” (Agency client databases) will not be used for direct marketing to third parties nor shared with competitors, in accordance with our Privacy Policy.

6. DISCLAIMER (REAL ESTATE AND INVESTMENTS)

• Ad Accuracy: While we require Agencies to enter accurate data, eBM does not guarantee that property descriptions, square footage, or legal status are 100% correct. It is the buyer’s responsibility to perform Due Diligence before purchasing.
• Investment Advice: Reports and analyses (“ROI Intelligence”, “Market Pulse”) are for informational purposes only. They do not constitute binding financial advice. eBM is not responsible for financial losses resulting from investments based on information from the portal.
• Legal Relations: The Sales or Lease Agreement is concluded exclusively between the Buyer and the Seller/Agency. eBM is not a contracting party in these transactions.

7. “HOME & LIVING” TERMS (ONLINE SHOPPING)

• Marketplace Model: Products in the “Home & Living” section are sold by our verified partners (Vendors). eBM processes the payment, but the Vendor is responsible for the delivery and quality of the goods.
• Complaints: Claims for damaged goods must be submitted via the eBM platform within 15 days of receipt and are resolved in cooperation with the Vendor.

8. PAYMENT AND REFUNDS

• Services: Payment for subscriptions, featured ads, or investment reports is made in advance.
• Success Fee: Agencies are obliged to pay a commission upon the realization of a deal, in accordance with the signed Cooperation Agreement.
• Refunds (Digital Goods): For digital products (Investment Reports, Guides), refunds are not possible once the content has been downloaded or sent, unless the content is technically defective.

9. TERMINATION AND SUSPENSION

eBM reserves the right to immediately, without prior notice, suspend or permanently terminate the account of a user who:

• Violates these Terms of Use.
• Enters false information.
• Attempts to bypass commission payments.
• Behaves inappropriately or offensively towards other users or eBM staff.

10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be interpreted in accordance with the laws of the Republic of Kosovo. All disputes that cannot be resolved amicably or through mediation shall be under the jurisdiction of the court in Prizren.
