Why “My Name on the Deed” Isn’t Enough to Sell!

As a real estate advisor in Kosovo, I often see a dangerous mistake among property sellers. Many clients come to my office and say: “The property is only in my name in the cadastre, so I can easily sell it by myself.”

If you bought this property while you were married, this thinking is wrong and very risky!

The Family Law Rule: Property Bought in Marriage Belongs to Both

Under Kosovo’s Family Law, any property you buy during your marriage is considered joint marital property. To stop people from selling family assets secretly or without their partner knowing, the law is very strict: both husband and wife must be physically present at the notary’s office to give consent and sign the sales contract.

You simply cannot sell or transfer the property without your partner’s signature.

The “Name on the Deed” Trap

Sellers often think that if only their name is written on the Cadastral Property Certificate, they are fine. But you need to know that the notary and your real estate agency will strictly check your marriage status. You must bring your spouse to the notary to sign, even if the property is registered under only one name due to old habits or paperwork issues.

What Happens If You Skip the Law? (Court Annulment)

What if you try to bypass this rule or “forget” to tell the notary that you are married? The consequences are severe. Many property sales that looked completely “clean” were later cancelled in court because the spouse did not sign.

If you sell marital property without your partner knowing, they have the full legal right to sue you. The court will cancel the contract, the sale will be ruined, and both you and the innocent buyer will end up in long, expensive court fights and huge financial trouble.

Quick Tip: To help couples register property together, there are no extra state fees for adding your spouse to the cadastre! Always talk to your real estate agent and bring your spouse to the notary to make sure your sale is 100% safe.

Quick Q&A Summary

Q1: The property certificate has only my name on it. Can I go to the notary and sell it alone?

A: No. If you bought the property during your marriage, Kosovo’s Family Law says your spouse must be there to sign the contract, no matter whose name is on the paper.

Q2: What are the risks if my spouse doesn’t sign the deal?

A: Your spouse can sue you, and the court will likely cancel the sales contract completely. This ruins the deal and creates huge legal and financial problems for everyone.

Q3: Does it cost extra money to register the property in both our names in the cadastre?

A: No. Currently, registering joint marital property in the cadastre is free from extra administrative fees. The state made it free to encourage couples to register property together.
